We respect your privacy when you use our services. This Privacy Policy is designed to apply to information that we have about you when you use our website, our mobile apps, and any other websites that use our APIs or services while you are logged in to your Account with us.

This Privacy Policy is expressly integrated into our AI as a Service Agreement, as if fully restated therein. Accordingly, this Privacy Policy is subject to the indemnification, liability limitation, mandatory arbitration, and class action waivers. You may opt out of the mandatory arbitration and class action waivers as set forth in section 8.5 of the Agreement.

1.Information we collect from you.

  1. 1.1. Information you submit to us.

    1. 1.1.1. Account information. We may collect personal information from you to set up your account, including your name, contact information, account credentials, payment information (which may be credit card, stripe, a bank account, or the like), and your transaction history.
    2. 1.1.2. User content. We may collect information when you use our services. This includes information you make publicly available using WordPress or similar services. This might include a blog post that includes biographic information.
    3. 1.1.3. Communication. When you communicate with us directly, interact with our service team, give feedback, and respond to surveys, we will store a copy of those communications as permitted by applicable law. We may also store information if you interact with our accounts on social media. (And social media platforms may provide us with aggregate information and analytics about that activity.)
    4. 1.1.4. If you apply for a job with us, we may collect additional information about you such as name, contact information, employment history, work authorization verification, and other information we request as part of the hiring process.
    1.2. Information we collect automatically.When you use our services or visit our website, we receive information about your visit and use including:

    1. 1.2.1. Log information that your device and browser send whenever you use our services, such as your IP address, browser type and settings, date and time of your request, and how you interacted with our website.
    2. 1.2.2. Transaction information. When you make a purchase through our services, we collect information about the transaction.
    3. 1.2.3. Location information. We may determine the approximate location of your device from your IP address. We collect and use this information to, for example, calculate how many people visit our services from certain geographic regions. We may also collect information about your precise location via our mobile apps (like when you post a photograph with location information) if you allow us to do so through your mobile device operating system’s permissions.
    4. 1.2.4. Device information. Data from your computer or mobile device, such as the type of hardware and software you are using to access our site or services.
    5. 1.2.5. Cookies. A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Pixel tags (also called web beacons) are small blocks of code placed on websites and emails. We use cookies and other technologies like pixel tags to help us identify and track visitors, usage, and access preferences for our services, as well as track and understand email campaign effectiveness and to deliver targeted ads.     6. 1.2.6. Analytics. We may use other companies under agreements with us to serve third-party advertisements when you visit the website and use the services. These companies may collect and use click stream information, browser type, time and date, subject of advertisements clicked or scrolled over during your visits to the services and other Web sites in order to provide advertisements about goods and services likely to be of greater interest to you. These companies typically use tracking technologies to collect this information. Other companies’ use of their tracking technologies is subject to their own privacy policies, not this one.
    7. 1.2.7. Information we collect automatically from others.

      1. 1.2.7.1. If you decide to register or log in through a third-party account, such Google, Facebook, Twitter, or WordPress, then we may collect personal data that is already associated with that account. Social Sharing services: If you connect your website or account to a social media service (like Twitter) through our Publicize feature, we’ll receive information from that service (e.g., your username, basic profile information, friends list) via the authorization procedures for that service.
      2. 1.2.7.2. Financial account Info: If you use WooCommerce Payments, we’ll receive information relating to your Stripe account, such as your email address and phone number. If you use WooPay, we’ll receive your payment information from Stripe.
      3. 1.2.7.3. Google Account Information: When you connect your Google account to your Newspack powered site, we may access certain Google user data such as your Google Ad Manager Configuration (the network code and your ad units) and your Google Analytics data to allow you to access and manage features more seamlessly. For example, you may be able to manage your Google ads and see your Google Analytics data directly within the dashboard of your Newspack powered site.

2.How we use the information we collect. We may use any of the above information for the following purposes:

  1. 2.1. To enable you to use our services, to create an account or profile, to process information you provide via our website or services (including verifying that your email address is active and valid) and to process your transactions;
  2. 2.2. To provide related customer service and care, including responding to your questions, complaints, or comments and sending surveys and processing survey responses;
  3. 2.3. To provide you with information, products, or services that you have requested or that we otherwise believe will interest you, including special opportunities from us and our third-party partners, improve the features algorithms, and usability of our Site, and/or services;
  4. 2.4. To tailor content, recommendations, and advertisements we and third parties display to you, both on the website and elsewhere online;
  5. 2.5. To calculate aggregate statistics on the number of unique devices using our website, services and to detect and prevent fraud and misuse of those;
  6. 2.6. To use for internal business purposes, such as to improve our website and services or to develop new programs and services;
  7. 2.7. To contact you with administrative communications and, in our discretion, changes to our privacy policy, terms of use, or any of our other policies;
  8. 2.8. To prevent fraud, criminal activity, or misuses of our services, and to ensure the security of our IT systems, architecture, and networks; and
  9. 2.9. To comply with regulatory and legal obligations.

3.Legal bases for collecting and using information. We will only use your personal data when the law allows us to. Most commonly, we will use your Personal Information in the following circumstances:

  1. 3.1. Where you have provided consent for us to use your personal data.
  2. 3.2. Where we need to use your personal data to fulfill our commitments to you under applicable terms of service.
  3. 3.3. Where we need to use your data to protect your vital interests or those of a third party.
  4. 3.4. Where we have a legitimate interest in using your information that does not override your fundamental rights, such as to provide and update our services; to improve our services so that we can offer you an even better user experience; to safeguard our services; to communicate with you; to measure, gauge, and improve the effectiveness of our advertising; and to understand our user retention and attrition; to monitor and prevent any problems with our services; and to personalize your experience.
  5. 3.5. Where we need to comply with a legal or regulatory obligation.

4.Sharing information. We share information about you in limited circumstances, and with appropriate safeguards on your privacy.

  1. 4.1. Vendors and service providers. To assist us in meeting business operations needs and to perform certain services and functions, we may provide Personal Information to vendors and service providers, including providers of hosting services, cloud services, and other information technology services providers, event management services, email communication software and email newsletter services, and web analytics services. Pursuant to our instructions, these parties will access, process, or store Personal Information only in the course of performing their duties to us.
  2. 4.2. Affiliates. We may disclose information to another entity that we control.
  3. 4.3. Billing. We use a third-party payment processor for credit cards. This service provider is not permitted to store, retain, or use billing information except for the sole purpose of credit card processing for Post Cheetah’s members.
  4. 4.4. Compelled disclosure. We may disclose your personal information if we are required to do so by law.
  5. 4.5. Change of control. In connection with any merger, sale of company assets, or acquisition of all or a portion of our business by another company, or in the unlikely event that we go out of business or enter bankruptcy, user information would likely be one of the assets that is transferred or acquired by a third party. If any of these events were to happen, this privacy policy would continue to apply to your information and the party receiving your information may continue to use your information, but only consistent with this privacy policy.
  6. 4.6. By consent. We may share and disclose information with your consent or at your direction. For example, we may share your information with third parties when you authorize us to do so, like when you connect your site to a social media service.

  8. 4.8. Aggregated or de-identified information: We may share information that has been aggregated or de-identified, so that it can no longer reasonably be used to identify you.   9. 4.9. Site owners: If you have a WordPress.com account and interact with another site using our services, your information may be shared with the administrators of the site. For example, if you leave a comment on a site created on WordPress.com or running Jetpack, your IP address and the email address associated with your WordPress.com account may be shared with the administrator(s) of the site where you left the comment. Or if you make a payment (like via the Payments feature) to a site, your public display name, user name, and email address may be shared with the administrator(s) of the site.
  10. 4.10. Information publicly shared. If you choose to make information public then you understand and agree that anyone may access, use, and disclose the information you post.

5.Storing information.

  1. 5.1. Post Cheetah retains your personal information to the extent necessary to reasonably serve customer relations, to meet our compliance and legal obligations, to enhance security and fraud prevention, and for audit purposes. For example, we may retain your information during the time in which you have an account to use our website or services and for a reasonable period of time afterward. We may also retain your information during the period of time needed for Us to pursue our legitim business interest, conduct audits, comply with our legal obligations, resolve disputes and enforce our agreements. We determine the appropriate retention period for the data on the basis of the amount, nature and sensitivity of your data processed, the potential risk of harm from unauthorized use or disclosure of your data and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation).
  2. 5.2. If you would like to modify or delete from our database any Personal Information you previously submitted to us, please let us know by emailing [email protected]. Please note that any Personal Information that we have copied may remain in back-up storage for some period of time after your request, and that if you delete certain information you may not be able to order services in the future without re-submitting such information.

6.Security. While no online service is 100% secure, we work very hard to protect information about you against unauthorized access, use, alteration, or destruction, and take reasonable measures to do so. We monitor our services for potential vulnerabilities and attacks.

7.Your rights.

  1. 7.1. GDPR. If you are located in a country that falls under the scope of the European General Data Protection Regulation ( “GDPR”), data protection laws give you certain rights with respect to your personal data, subject to any exemptions provided by the law, including the rights to:

    1. 7.1.1. Request access to your personal data;
    2. 7.1.2. Request correction or deletion of your personal data;
    3. 7.1.3. Object to our use and processing of your personal data;
    4. 7.1.4. Request that we limit our use and processing of your personal data; and
    5. 7.1.5. Request portability of your personal data.

You also have the right to make a complaint to a government supervisory authority about our collection and use of your personal data.
  2. 7.2. U.S. Privacy Laws. Laws in some US states, including California, Colorado, Connecticut, Utah, and Virginia, require us to provide residents with additional information about the categories of personal information we collect and share. Subject to certain exemptions in state law, residents may have the right to:

    1. 7.2.1. Request a copy of the specific pieces of information we collect about you and, if you’re in California, to know the categories of personal information we collect, the categories of business or commercial purpose for collecting and using it, the categories of sources from which the information came, and the categories of third parties we share it with;
    2. 7.2.2. Request deletion of personal information we collect or maintain;
    3. 7.2.3. Request correction of personal information we collect or maintain;
    4. 7.2.4. Opt out of the sale or sharing of personal information;
    5. 7.2.5. Receive a copy of your information in a readily portable format; and
    6. 7.2.6. Not receive discriminatory treatment for exercising your rights.
  3. 7.3. California specifically requires that we disclose whether we have in the past 12 months collected information in these categories:

    1. 7.3.1. Identifiers (like your name, contact information, and device and online identifiers);
    2. 7.3.2. Commercial information (your billing information and purchase history, for example);
    3. 7.3.3. Characteristics protected by law (for example, you might provide your gender as part of a research survey for us or you may choose to voluntarily disclose your race or veteran status as part of your job application);
    4. 7.3.4. Internet or other electronic network activity information (such as your usage of our services, like the actions you take as an administrator of a WordPress.com site);
    5. 7.3.5. Geolocation data (such as your location based on your IP address);
    6. 7.3.6. Audio, electronic, visual or similar information (such as your profile picture, if you uploaded one);
    7. 7.3.7. Professional or employment-related information; and
    8. 7.3.8. Inferences we make (such as likelihood of retention or attrition).

The information that you share with these third parties will be governed by their specific privacy policies and terms of service and not by this privacy policy. By providing these links to you or other users, we do not imply that we endorse or have reviewed these sites. Please contact those third parties directly for information on their privacy practices and policies.

10. Updates to this policy. We may change this privacy policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by applicable law. By continuing to use our service or providing us with Personal Information after we have posted an updated privacy policy, or notified you by other means, you consent to the revised privacy policy.
